Terms of Service
These Terms of Service (“Terms”) govern your access to and use of PuckCast (the “Service”), operated by OWSH Unlimited (“PuckCast,” “we,” “us”). By creating an account, subscribing, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. What PuckCast is — and is not
PuckCast is an analytics and information service. We publish NHL game predictions, win probabilities, player projections, fantasy tools, and betting-related analysis generated by statistical models. All content is provided for informational and entertainment purposes only.
PuckCast is not a sportsbook, gambling operator, bookmaker, or financial advisor. We do not accept, place, or facilitate wagers, and we do not handle betting funds. Nothing on the Service is a solicitation, recommendation, or instruction to place a bet, and no output constitutes financial, investment, or professional advice.
2. No guarantee of results
Model predictions are probabilistic estimates, not statements of fact about future events. Historical accuracy figures describe past model performance under backtesting or live tracking and do not guarantee future results. Sports outcomes are inherently uncertain. Any decision you make based on PuckCast content — including any decision to place a wager where legal — is made solely at your own discretion and risk. We accept no liability for any losses, financial or otherwise, arising from your use of the Service.
3. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. If you use PuckCast in connection with sports betting, you are solely responsible for confirming that such activity is legal where you are located and for complying with all applicable laws. Sports betting is restricted or prohibited in many jurisdictions and is typically limited to persons 21 and older.
4. Accounts
Some features require an account. You are responsible for the information you provide, for keeping your credentials secure, and for all activity under your account. Notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms.
5. Subscriptions and billing
Paid features (“PuckCast Edge”) are offered on a subscription basis. Pricing, billing frequency, renewal, and cancellation are described on our checkout and in our Refund & Cancellation Policy, which is incorporated into these Terms. Payments are processed by Stripe; we do not store your full card details. You authorize us and Stripe to charge your payment method for the plan you select, including any automatic renewals, until you cancel. The monthly plan bills during the NHL season only and pauses for the offseason; the season pass renews yearly.
6. Acceptable use
You agree not to:
- scrape, harvest, resell, or redistribute PuckCast data or predictions without written permission;
- reverse engineer, or attempt to derive the underlying models or source data;
- share, resell, or provide access to a paid account with others;
- interfere with, overload, or attempt to gain unauthorized access to the Service or its infrastructure; or
- use the Service for any unlawful purpose or in violation of any applicable gambling law.
7. Intellectual property
The Service, including its models, outputs, text, design, and code, is owned by PuckCast / OWSH Unlimited and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable license to access the Service for your own personal, non-commercial use. NHL team names and marks belong to their respective owners; PuckCast is not affiliated with, endorsed by, or sponsored by the National Hockey League.
8. Disclaimer of warranties
The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that predictions will be accurate, that the Service will be uninterrupted or error-free, or that data will be complete or current.
9. Limitation of liability
To the maximum extent permitted by law, PuckCast and OWSH Unlimited will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, or gambling losses, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months preceding the claim (or USD $100 if you paid nothing).
10. Indemnification
You agree to indemnify and hold harmless PuckCast and OWSH Unlimited from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any law or third-party right.
11. Changes
We may update these Terms from time to time. Material changes will be reflected by the “last updated” date above and, where required, by notice to you. Continued use of the Service after changes take effect constitutes acceptance.
12. Governing law
These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in New York.
