Terms of Service
1. Who we are
PuckCast (the “Service”) is run by OWSH UNLIMITED, LLC, a New York limited liability company based in Buffalo, New York (“OWSH,” “PuckCast,” “we,” “us”). By creating an account, subscribing, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service. Our Privacy Policy explains how we handle personal data.
2. What PuckCast is, and is not
PuckCast is an analytics and information service. We publish NHL game predictions, win probabilities, player projections, fantasy tools and betting-related analysis generated by statistical models. All content is for informational and entertainment purposes only.
PuckCast is not a sportsbook, bookmaker, gambling operator or financial advisor. We take no bets, place no bets, hold no betting funds and pay no winnings. We have no affiliation with, and receive no payment from, any sportsbook. Sportsbook names only show where a price came from. Nothing on the Service is a solicitation, recommendation or instruction to place a bet, or financial, investment or professional advice.
3. Predictions are estimates
Predictions, probabilities and ratings are statistical estimates, not statements of fact about future events. They are not guaranteed to be accurate or profitable. Past results, including results against past betting lines, do not predict future results. Sports outcomes are uncertain. Any decision you make using PuckCast content, including any decision to place a wager where it is legal, is made solely at your own discretion and risk.
Data is provided on a best-effort basis. It may be wrong, late, incomplete or changed after the fact, and it may not match official league records. Odds shown are indicative and may differ from what a sportsbook offers. Check with the sportsbook or the official source before you act.
4. Eligibility
You must be at least 21 years old to use the Service. If you bet, meeting the legal betting age where you live is your responsibility, and it may be higher than 21. Sports betting is restricted or prohibited in many places. Confirming that it is legal where you are is your responsibility. You must follow all laws that apply to you. We may close an account we learn belongs to someone under 21.
5. Accounts
Some features require an account. You are responsible for the information you give us, for keeping your sign-in details secure, and for all activity under your account. Tell us promptly of any unauthorized use. We may suspend or end accounts that break these Terms.
6. Subscriptions, renewals and cancellation
Paid features (“PuckCast Edge”) are sold as a subscription. The monthly plan bills every month until you cancel and you can pause it yourself from your account (members on an earlier monthly plan keep that plan's own terms). The Season Pass bills once a year, renewing every 12 months on your purchase date. The price, how often you are charged, and the renewal date are shown at checkout before you pay, and we email them to you after you subscribe. Payments are processed by Stripe. We do not store your full card details.
Subscriptions renew automatically each billing period (monthly from October through June for the monthly plan, yearly for the Season Pass) until you cancel. You authorize us and Stripe to charge your payment method for each renewal at the price shown when you subscribed.
You can cancel at any time from your account settings, which open the Stripe billing portal. You can also email hello@puckcast.ai. Cancelling takes effect at the end of the period you already paid for. You keep access until then and we do not charge you again.
If a payment fails, we may retry it and may suspend paid access until it succeeds. If it stays unpaid, the account returns to the free tier. You pay any taxes that apply.
7. Refunds
PuckCast Edge is a digital service delivered right away, so payments are generally not refundable, including for a partly used period or unused time after you cancel. We make exceptions if you were charged in error, were charged after you cancelled, or had a genuine problem getting access to the Service. For those, email hello@puckcast.ai from your account email and we will review it and refund where warranted. The same rule appears in our Refund & Cancellation Policy. Statements elsewhere on our site, in emails or in support replies add no other refunds unless we confirm them in writing. Where the law requires a refund, we give it.
8. Acceptable use
You agree not to:
- scrape, harvest, resell, or redistribute PuckCast data or predictions without written permission;
- redistribute odds, lines or prices as a raw or bulk feed, file or dataset;
- reverse engineer, or attempt to derive the underlying models or source data;
- share, resell, or provide access to a paid account with others;
- interfere with, overload, or attempt to gain unauthorized access to the Service or its infrastructure; or
- use the Service for any unlawful purpose or in violation of any applicable gambling law.
9. Intellectual property
The Service, including its models, outputs, text, design and code, is owned by OWSH and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your own personal, non-commercial use. NHL team names and marks belong to their owners. PuckCast is not affiliated with, endorsed by, or sponsored by the National Hockey League or any team, player or sportsbook.
10. Disclaimer of warranties
THE SERVICE AND ALL DATA ARE PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE FULLEST EXTENT THE LAW ALLOWS, WE MAKE NO WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ACCURACY, COMPLETENESS, TIMELINESS, AVAILABILITY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. We do not promise that predictions will be accurate or that the Service will be uninterrupted or error-free.
11. Limit of liability
To the fullest extent the law allows:
- WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA OR GOODWILL.
- WE ARE NOT LIABLE FOR ANY LOSS FROM BETTING, WAGERING OR INVESTING, OR FROM DECISIONS YOU MAKE USING THE SERVICE, EVEN IF THE DATA WAS WRONG, LATE OR MISSING.
- OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS THE GREATER OF WHAT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT, OR $100.
These limits do not apply to our gross negligence, willful misconduct or fraud, or where the law does not allow them. They do not reduce any refund owed under these Terms.
12. Indemnification
If you use the Service in a business or product you offer to others, you will defend and hold us harmless from third-party claims arising from your breach of these Terms or your violation of law or a third party’s rights. This does not apply to individuals using the Service for their own purposes.
13. Changes to these Terms
We may change these Terms. For a material change, we email the address on your account and update the date above at least 30 days before it takes effect. If the change is materially worse for you, you can cancel before it takes effect. Fixes and legally required changes may take effect sooner. If you keep using the Service after a change takes effect, you accept it. We also email you at least 30 days before a price increase on a paid plan.
14. Governing law and courts
New York law governs these Terms. Any lawsuit must be filed in the state courts in Erie County, New York, or the U.S. District Court for the Western District of New York, and you and we agree to their jurisdiction. Either of us may bring an individual claim in small claims court. If you are a consumer, nothing here removes protections that the law where you live does not allow you to give up.
